Overview of Federal Laws About Cocaine

Cocaine is a powdered stimulant especially popular with major drug dealers. Under the federal laws of the United States of America possession of the drug is a crime. Possessing crack cocaine (a cheaper version of the drug) counts as an even larger offense. Controlled Substances Act

According to the Controlled Substances Act, drugs are classified under schedules I, II, III, IV, and V. Cocaine falls under schedule II as It has the following characteristics:

  • The drug has a high potential for substance abuse
  • Extreme dependency on the drug can lead to severe physical and psychological defects
  • The drug is currently used as a form of medical treatment in the United States of America. But its use has severe restrictions

Simple and constructive possession

If an individual gets caught knowingly possessing cocaine under his personal or physical control, they can be charged with "simple" possession.

Individuals are also arrested for "constructive" possession of cocaine under federal law. This is when the individual has control over the distribution sale of the drug. For example, an individual trying to smuggle cocaine through the airport either on their person or in their belongings can be charged with this crime. Additional cases of constructive possession of cocaine include:

  • Cocaine found in an individual's home
  • Cocaine found in the hotel room where the individual stayed
  • Cocaine bought at a club owned or managed by the individual
  • The individual is associated with a warehouse that cocaine was found in
  • A parcel addressed to the individual had cocaine in it
  • The individual is closely associated with someone else who was accused of constructive possession of cocaine

Penalties for possession of cocaine

Any individual found guilty of possession of cocaine (Schedule II) will face the following penalties:

Possession of cocaine: 500-4999 grams

First offense

A minimum prison sentence of five years, and a maximum sentence of 40 years. If the individual's acts have resulted in the injury or death of another person, they will have to face minimum prison time of 20 years, up to life.

The individual operated alone, they will have to pay a fine of $2 million. If a group or nexus of cocaine dealers is busted, they will have to pay a fine of $5 million.

Second offense

A minimum prison sentence of 10 years, up to life imprisonment. If the individual's actions resulted in the injury or death of someone else, they will face life imprisonment.

If an individual is arrested, they will have to pay a fine of $4 million. If a group is busted, they will have to pay a fine of $10 million.

Possession of Cocaine: 5 kg or more

First offense

A minimum prison sentence of 10 years, up to life. If the individual has caused injury or death to someone else, then they will be sentenced to minimum of 20 years in prison, up to life.

If an individual was operating alone, they will have to pay a fine of $4 million. if a group got arrested for dealing with and selling cocaine, they will have to pay a fine of $10 million.

Second offense

An individual arrested for the second time on charges of dealing in cocaine will be sentenced to minimum of 20 years in prison, up to life. If the individual was operating alone, they will be required to pay a fine of $8 million. If a group was busted for dealing with and selling cocaine, they will have to pay a fine of $20 million.
