How to Obtain a Free Background Check in the State of South Dakota?

Background checks can be carried out- officially and unofficially. It’s the South Dakota Attorney General Office- Department of Criminal Investigation that carries out official background checks. The official fee to conduct an online criminal background search fee is $20. The background check procedure/ system comprises a fingerprint method which the applicant needs to pay for it.

Arrest Record Check:
Record of arrests and convictions are available at the county courthouse for a fee of $20. An arrest record can also be requested via email. Certain records are restricted and not freely available to the public viz., warrants, DUI, drugs and marijuana, sex offenses, parole, probation, etc
- Warrants: individuals who are keen to find out if they have a warrant- must approach local enforcement agency to check for outstanding warrants (if any)
- DUI: such records are available for a duration of 10 years on state and federal databases. To obtain this record- a signed consent is a necessity.
- Drugs/ Marijuana: record shows details viz., minimum/ maximum sentence, the quantity of substance, sales/ production, etc Failed drug tests are not included.
- Sex offender: Individuals must visit the state registry for self-determination of sex offender status.
- Parole/ probation status: only active statuses of parole/ probation will be included in the criminal background check.
