The applicants need to fill out a background check report and sign it so that employers can perform an employment background check in Illinois.

Illinois is one of several U.S. states that have passed the ban-the-box law; the law, also known as Opportunities for Qualified Applicants Act, limits employers from asking about criminal records; under the law, employers are prohibited from asking about criminal history until the later stages of the application process. The law does not apply for all Illinois employers, but only those who have 15 employees or more. Employers who wish to ask about applicants' criminal records may do so when:

  • They determined the applicant is qualified for the open position
  • They notified applicants that they were selected to advance to an interview. If there is no need for an interview, employers can ask about criminal records during the extended conditional job offer
