The law in Kansas allows employers of independent contractor work to determine fitness for employment. If a Kansas employer rejects an applicant because he/she has been convicted of a crime, Kansas law exempts the employer if the decision “reasonably bears” on the applicant's performance in the job.

To even out the playing field, the Kansas Human Rights Commission issued guideline employers can follow called Guidelines on Equal Employment Practices: Preventing Discrimination in Hiring. According to the guidelines, Kansas employers cannot ask applicants about their arrests and their nature, unless the crimes are "substantially related” to the applicant's ability to perform the duties of the job. Also, job applicants in Kansas who have criminal records that have been expunged are not required to disclose the information in their job application. So, while there are no clear Kansas background check laws, there are guidelines that protect both employer and applicants' rights.
