In 2018, there were 253,251 Michigan background checks, and it is estimated that more than 90% of employers in the state perform background checks on job applicants. According to federal law, an employer may ask about a criminal background check only on the late stages of the hiring process, and not in early interviews.

On a state level, employers in Michigan are prohibited from asking applicants about misdemeanor arrests, but they can ask about misdemeanor or felony convictions and felony arrests. If misdemeanor arrests did not result in a conviction, Michigan employers may not ask about them. employers in Michigan are allowed to ask applicants about convictions for misdemeanors and arrests and convictions for felonies. To protect the rights of applicants in the state, Michigan’s Department of Civil Rights has issued a Pre-Employment Inquiry Guide that directs employers how and when they are allowed to ask about applicants' criminal records.
