Background Check Statistics and Laws in Nevada

The industry in the state of Nevada has approximately 400,000 employees, and most of them have gone through a background check before they were hired. The state, like other states in the country, perform criminal background checks on job applicants, and also people who wish to purchase firearms. In 2018, the NICS performed 67,920 firearms background checks for those who applied for a gun license/wanted to purchase firearms. To protect the right of applicants in Nevada, Nevada has legislated laws that limit which records employers can view. Nevada employers may only get information on applicants' criminal history unless the applicants give their consent to do so. Considering the fact that Nevada is famous for its casinos, there are certain exceptions for applicants who seek employment in the gambling industry; in these cases, employers are allowed to request access to sealed criminal records. The purpose of this unique law is to discover if applicants who search for employment in the gaming industry were convicted of offenses that are related to gaming.

In other cases, that are not related to gaming, employers cannot ask about applicants' criminal records in the first stages of the hiring process. Only as the interviews progress and applicants get conditional offers can employers request consent to perform a criminal background check.
