As a result, employers in the state are performing Rhode Island criminal background checks more than they used to. The national average of background checks for jobs is more than 90%, and Rhode Island is no different. Also, licensed gun dealers in the state perform firearm background checks on individuals wishing to purchase firearms, as required by law. In 2018 the NICS performed 13,960 firearm background checks in the state of Rhode Island.

Rhode Island criminal background checks are performed by either expert third-party companies, or by the FBI. Federal law requires employers to get applicants' written consent if they wish to perform a background check. On a state level, Rhode Island employers are prohibited from asking applicants if they were ever arrested or convicted of a crime during the first stages of the hiring process. Employers are able to ask about convictions in the following limits:

  • Employers may ask about convictions for specific offenses on an employment application unless the conviction for such an offense would disqualify the applicant from holding the position under state or federal law, or would preclude bonding for a position that requires it.
  • Employers are prohibited from asking about convictions in the application form.
  • During the first interview, employers are allowed to ask about convictions, but applicants are not required to answer about expunged convictions.
