Individual states also have state laws protecting the rights of applicants with criminal records, but South Dakota is not one of them; the state has no legislation in the matter that prevents private employers from discriminating individuals with criminal records. However, the South Dakota Department of Labor issued a “Pre-Employment Inquiry Guide” that guides employers not to ask about criminal arrests and convictions that are not related to the position they are hiring for.
