The state of South Dakota has experienced an increase in crime rates, which led to more and more employers and gun vendors to perform criminal background checks on individuals. To protect the rights of job seekers in South Dakota and other states, the U.S. has set federal law; the only way employers are allowed to perform criminal background checks on applicants is if they have written consent to do so. Individual states also have state laws protecting the rights of applicants with criminal records, but South Dakota is not one of them; the state has no legislation in the matter that prevents private employers from discriminating individuals with criminal records. However, the South Dakota Department of Labor issued a “Pre-Employment Inquiry Guide” that guides employers not to ask about criminal arrests and convictions that are not related to the position they are hiring for.
