What is the Law on Murder in Washington and What are the Punishments for it?

A criminal act can be performed by any person; a civilian or defense personnel. The difference is in which court the trial will take place and which law will apply. Military justice governs all people of the armed forces. The guidelines laid under military justice ensures that all defense members follow the order, are disciplined and have appropriate conduct as required by the defense system. All states in the US have a military justice system in the place which would look into matters related to civil misconduct committed by the armed forces.

Article 118 of the Uniform Code of Military Justice (UCMJ)

The article 118 deals with the murder committed by a defense person from army, navy, air force and a coastguard. Under Article 118, a murder charge is subcategorized in four buckets in Washington:

Premeditated Murder in Washington

Premeditated murder is said to have been committed when:

o  The victim is dead

o  The death resulted from the act committed by the accused defense person

o  The act of killing was unlawful

o  The accused had a premeditated design to execute the killing

When the charges of murder are proven under this category, military law considers it as the worst form of criminal conduct. A proven charge can result in the death penalty or minimum life imprisonment with a possibility of parole.

Washington Murder Law

Intentional killing

Intentional murder is said to have been committed when:

o  The victim is dead

o  The death resulted from the act committed by the accused defense person

o  The act of killing was unlawful

o  The accused had a clear intent to execute the killing or the least to inflict bodily harm/ injury upon the victim

Proven charges under this category may incur a reduced punishment compared to premeditated murder convictions.

To be dangerous to another individual

An above-listed category of murder is said to have been committed when:

o  The victim is dead

o  The death resulted from the intentional act committed by the accused defense person

o  The actions taken by the accused were dangerous and had a total disregard for life

o  The accused knew that his actions will cause bodily injury

o  The act of killing was unlawful

Murder Law Washington

During certain offenses

o  The victim is dead

o  The death resulted from the act committed by the accused defense person

o  The act of killing was unlawful

o  At the time of the murder, the accused intended to perform another crime

Murder by a defense person is a crime which is in violation of both military and state civilian law. Such cases are tried in military and/ or a civilian court however, the typically military court takes these cases under its charge. A defense member cannot be convicted both by the military and the federal court for the same crime.

Under the UCMJ, a violator of the military code will undergo court martial for various violations of The Code. There are three types of court-martial namely, summary, special and general.

Murder Law

  • General Court-martial– is used to deal with egregious crimes such as rape, arson, and murder. The panel conducting the court-martial comprises a military judge and five other senior defense members. The panel under this category has the authority to award:

o  Confinement

o  Pay forfeiture

o  Dishonorable discharge

o  Life Imprisonment (with or without the possibility of parole)

o  Death sentence

Any member of defense charged and convicted for murder may also stand a chance of losing all his military benefits. It may require them to complete their tenure in the military prison and then face Washington state prison once released from the military.
