Delaware Public Records

A public records law in the state of Delaware was first passed in 1977 and it permits any citizen in the state to file a request for accessing public records. The state has two kinds of public records:

  1. Government records – these records include inmate records, land records, court records, tax records, crime data and more.
  2. Personal records – contain birth records and certificates, marriage and divorce records, death certificates, and more personal documents.

The public records law in Delaware permits any person to file a request to get a copy of a public records, and the agencies who receive the requests are obligated to reply within 15 days. You do not have to provide a reason when requesting access to public records under the Delaware Freedoms of Information Act that gives access to over 8.5 million public records in the state.

The law listing in Delaware started in 1935 with the 105th General Assembly. The listing was compiled along with the assistance of the Government Information Center, and it continues to change as the years go by. Each additional page costs $0.1 for a single sheet and $0.2 for a double-sided sheet (fees apply to copies in the standard size of 8.5” x 11”; 8.5” x 14”; and 11” x 17”).

Oversized photocopy fees of public records are as follows:

18x 22”:       $2.00 per sheet

24x 36”:       $3.00 per sheet

Documents larger than 24” x 36”: $1.00 per square foot.

Printouts/color copies costs:

$1.00 per sheet - 8.5” x 11”; 8.5” x 14”; and 11” x 17” sheets.

$1.50 – per sheet for larger copies.
